PAPA REWARDS PERKS MLB® SUMMER SWEEPSTAKES OFFICIAL RULES

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

  1. Eligibility: The Papa Rewards Perks MLB® Weekend Sweepstakes (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their state of legal residence, whichever is older) at the time of entry. Employees, owners, officers and directors of Papa John’s National Marketing Fund, Inc., Papa John’s International, Inc., Papa John’s U.S.A, Inc., MLB Entities (as defined in Section 12 below), Fanatics, Inc. and each of their respective parents, subsidiaries, affiliates, franchisees, contractors and promotional fulfillment and marketing agencies (“Sweepstakes Entities”) as well as the immediate family (spouse, parents, siblings and children, regardless of where they live) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

  2. Sponsor: Papa John’s National Marketing Fund, Inc., 2002 Papa John’s Boulevard, Louisville, KY, 40299.

  3. Timing: The Sweepstakes has three (3) separate entry periods as set forth in the table below (each, an “Entry Period”) whereby different prizes can be won during each of the separate Entry Periods. For this Sweepstakes, the start and end dates for each Entry Period are as follows:

    Entries submitted before or after the applicable Entry Period will not be eligible. Sponsor’s computer is the official time-keeping device for the Sweepstakes.

  4. How to Enter: No purchase and no entry fee, payment or proof-of-purchase necessary to participate in this Sweepstakes. You may enter the Sweepstakes in one of the following ways:

      (A) ENROLLMENT IN PAPA REWARDS

        (i) Existing Papa Rewards members: You will automatically be entered in the Sweepstakes one (1) time simply because you are a Papa Rewards member.

        (ii) Existing accountholders not enrolled in Papa Rewards: Log into your account at papajohns.com and then click on the Dashboard. On the Dashboard page, click the “Please Enroll Me in Papa Rewards” box.

        (iii) New accountholders: Go to papajohns.com and click on “Sign In or Create An Account”and then click on “Create an Account” and check “Enroll me in Papa Rewards.” Click “Create an Account” to complete account creation and Papa Rewards enrollment.

        (B) WITHOUT ENROLLMENT IN PAPA REWARDS.

          You may enter the Sweepstakes during an Entry Period without enrolling in Papa Rewards by sending an email to prperks@papajohns.com with your name, mailing address, daytime telephone number, and date of birth (to confirm age eligibility).

          NOTE: Current Papa Rewards members may opt-out of being automatically included in the Sweepstakes at any time by sending an email request with their name, physical address, and the email address used to place online orders at papajohns.com by the end date and time for each Entry Period as shown in the Timing section of these rules to OptOut@papajohns.com.

          Limit: One (1) entry per person/household during the applicable Entry Period, regardless of method of entry. Papa Rewards members enrolled by the end date and time of Entry Period 1 will be automatically enrolled in future Entry Periods as defined in Section 3 Timing, as long as they do not unenroll in Papa Rewards before the end of the Entry Period. Any Papa Rewards member who unenrolls after any Entry Period will not be entered in subsequent Entry Periods without completing one of the entry methods set forth above. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than one (1) entry per Entry Period by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system (including but not limited to entries made using any script, macro, bot or sweepstakes service) to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address.

  5. Prizes: The number and type of prizes for each Entry Period are as follows:

        Entry Period 1 Prizes: ONE THOUSAND (1,000) PRIZE WINNERS: Each Entry Period 1 winner will receive one (1) $100 MLBShop.com electronic gift certificate, subject to the terms and conditions associated with its use (for details, visit https://help-mlb.custhelp.com). Approximate Retail Value (“ARV”) of each Entry Period 1 prize: $100; ARV of all Entry Period 1 Prizes: $100,000.

        Entry Period 2 Prizes: FIVE HUNDRED (500) PRIZE WINNERS: Each Entry Period 2 winner will receive one (1) Louisville Slugger baseball bat. ARV of each Entry Period 2 prize: $36; ARV of all Entry Period 2 Prizes: $18,000.

        Entry Period 3 Prizes: FIVE HUNDRED (500) PRIZE WINNERS: Each Entry Period 3 winner will receive one (1) Official MLB Rawlings baseball. ARV of each Entry Period 3 prize: $20; ARV of all Entry Period 2 Prizes: $10,000.

        Grand Prizes: APPROXIMATELY ONE HUNDRED FIVE (105) WINNERS BASED ON AN AVERAGE OF GRAND SLAMS HIT DURING PAST MLB REGULAR SEASONS. Each grand prize drawing winner will receive six hundred (600) Papa Rewards points electronically deposited into the Papa Rewards members’ online accounts valued at $312. Papa Rewards Points are subject to the terms and conditions associated with its use (for details, visit papajohns.com/order/papa-rewards). Grand prizes winners not enrolled in Papa Rewards may either enroll in Papa Rewards and the Papa Rewards points will be deposited into their accounts or opt to receive the prize awarded as a $312 Papa John’s Gift Card, subject to terms and conditions associated with its use (for details, visit papajohns.com/gift-cards). ARV if each Grand Prize is $312. ARV of all Grand Prizes: Approx. $32,760 based on an average of 105 grand slams hit during MLB regular seasons.

      For all Prizes: Terms and conditions of electronic gift certificate and Papa Rewards Points redemption apply. Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize for a prize of equal or greater value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes and fees associated with prize receipt and/or use. Limit: one (1) prize per person/household. Total ARV of all prizes: $160,760.

  6. DRAWINGS:

    For each Entry Period, potential winners as set forth in the table below will be selected in a random drawing from among all eligible entries received for each Entry Period held prior to the applicable Entry Period on the applicable drawing date set forth in the table below. Non-winning eligible entries from one Entry Period will carry-over to and remain eligible for subsequent Entry Period(s).

      GRAND PRIZE DRAWING: OSponsor will draw one potential grand prize winner for each grand slam hit by Major League Baseball players during an official game played during the 2017 MLB regular season. The total number of potential grand prize winners will be based on the total number of officially recorded grand slams hit by Major League Baseball players during an official game played during the 2017 Major League Baseball® regular season. Potential grand prize winners will be selected in a random drawing to take place on or around October 6, 2017, from all eligible entries received during all Entry Periods.

      Sponsor’s decisions as to the administration and operation of the Sweepstakes and the selection of the potential winners are final and binding in all matters related to the Sweepstakes. Odds of winning a prize depend on the number of eligible entries received for each Entry Period held prior to the applicable drawing (and for the grand prize, the number of grand slams hit during the 2017 MLB regular season as set forth above). The potential winners will be notified by email from Fulfillment@papajohns.com. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes. Each potential winner will be required to sign and return a Declaration of Compliance, Liability Waiver and, where not prohibited, a Publicity Release ("Declaration") which must be received by Sponsor within three (3) business days of the date notice or attempted notice is sent in order to be declared an official winner and claim his/her prize. If a potential winner of any prize cannot be contacted, declines the prize for any reason or fails to sign and return the Declaration or provide any other requested information within the required time period, or the prize is returned as undeliverable, the potential winner forfeits his/her prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a potential winner is disqualified for any reason or the prize is forfeited, Sponsor may select an alternate potential winner by random drawing from among all remaining eligible entries received for each Entry Period held prior to the applicable drawing. Only one (1) alternate drawing may be held for all prizes, after which the applicable prize will remain un-awarded. Entry Period prizes will be fulfilled within approximately 2-4 weeks after the conclusion of the applicable Entry Period. Grand prize will be fulfilled within approximately 1-2 weeks after the conclusion of the grand prize drawing date.

  7. Release: By entering the Sweepstakes, entrants agree to release and hold harmless Sponsor, Papa John’s International, Inc., Papa John’s U.S.A., Inc., MLB Entities (as defined in Section 12 below), Fanatics, Inc. and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

  8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ and the MLB Entities’ perpetual use of such winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

  9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any person responsible for the attempt to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

  10. Limitations of Liability: The Released Parties are not responsible for (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of Prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of Prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

  11. Disputes: Except where prohibited, each entrant agrees that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Western District of Kentucky or the appropriate Kentucky State Court located in Jefferson County, Kentucky; (2) any and all claims, judgments and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Kentucky without giving effect to any choice of law or conflict of law rules (whether of the State of Kentucky or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kentucky.

  12. MLB Entities Definition and Disclaimer: The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLBAM” or “MLB.com”), Major League Baseball Properties, Inc., The MLB Network, LLC, BAMTech, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The MLB Entities will have no liability or responsibility for any claim arising in connection with this Sweepstakes or any prize awarded. The Sweepstakes is not sponsored, administered, executed or produced by any MLB Entity. The MLB Entities (a) make no warranty, guaranty or representation of any kind concerning any prize (or any portion thereof), and (b) disclaim any implied warranty.
